General Terms and Conditions

Please read this document carefully because, by finalising your order in the webshop, you accept the content of the General Terms and Conditions (hereinafter GTC). Please only use the services of Service Provider’s webshop if you agree with all the provisions of the GTC and consider them binding on you. The GTC shall apply for orders placed at Service Provider’s webshop.

Hosting Service Provider shall be responsible for maintaining the webshop and providing the necessary storage space for the webpage and the data related thereto.

1. Basic provisions

1.1.Service Provider shall reserve all rights over the website, any part of the website and the content displayed thereon, and distribution of the website. It is forbidden to download, electronically store, process or sell content displayed on the website or any part thereof without the prior written consent of Service Provider.

Service Provider shall be entitled to modify the GTC at any time, which modifications shall come into effect after being published on the website.

This GTC and the legal relationship established between Parties shall be governed by Hungarian law. If a provision is unlawful, invalid or unenforceable, it shall not affect the legality, validity or enforceability of other provisions.

1.2. Scope and acceptance of the GTC

The content of the contract between Service Provider and you as Customer (hereinafter Customer) is defined by the General Terms and Conditions in addition to the provisions of the applicable binding legislation. Before finalising an order, Customer must read the provisions of the GTC. Customer’s declaration in respect thereof and the date thereof will be electronically stored by Service Provider. According to Act CVIII of 2001 on certain issues of electronic commerce activities and information society services, the contract accepted by Customer and governed by the following terms and conditions shall be considered a distance contract that shall not be filed by Service Provider. Parties shall not sign a separate written contract.

The webshop operates in all countries.

The technical requirements necessary for the use of the website and the digital products as well as other relevant information, which are not included in the GTC, shall be provided by other information materials (e.g. End-User Licence Agreement) available on the website.

2. Available products and services

The printed publications and digital content available for purchase in the webshop (hereinafter referred to as Mozaik Content) form the subject of the contract. Service Provider shall provide information on the website about the essential characteristics of products available for purchase in the description of each product. If the subject of the purchase is a printed product, Service Provider shall offer delivery of the product as a service to be ordered. Moreover, Customer shall be offered the opportunity to review the publications and to review the demo version of the digital content. In the event that a product or service is purchased, the price indicated on the website shall be paid. In the event of any potential errors, the provisions of the Hungarian Civil Code Act (Act V of 2013) shall apply.

By making a purchase, Customer shall acquire a restricted right of use of Mozaik Content. The restricted right of use constitutes a right that shall not extend to the reproduction, processing and translation of Mozaik Content. Customer shall be entitled to the following actions with Mozaik Content: Customer can run, display and store Mozaik Content on Customer’s own device. The restricted right of use shall not extend to the public presentation or broadcast of Mozaik Content – except when used for educational purposes in the classroom or during special classes when video communication software is used. Furthermore, the restricted right of use shall not extend either to transfer of the right to Third Parties or assignment of any title.

The fees to be paid for digital products, in accordance with the concept of royalties defined in Hungarian Act C of 1990 on Local Taxes, Sec 52 para 51, shall be considered income deriving from the licence to use and the authorisation for use of software protected by copyright. Furthermore, in accordance with Hungarian Act LXXXI of 1996 on Corporate Tax and Dividend Tax, Sec 4. para 20, the result of product sales shall be considered income deriving from the licence to use and the authorisation for use of software protected by copyright.

3. Copyright

Mozaik Content comprises software and the complex intellectual products, including any data, software and information as well as any hypertext markup language files, command files, computer programs, images and sound recordings, audio, video, music and graphic files, photos, 3D animations, widgets, etc. that constitute the exclusive property of Service Provider and said Service Provider’s right of use. Mozaik Content is protected by Hungarian and international copyright and other laws on intellectual property.

Mozaik Content includes the following products available for purchase in the webshop: mozaBook, mozaWeb, mozaMap, CadaVR, Euler3D, Euklides, mozaik3D, LabCamera, Fizika, Matek, Home and Classroom versions of textbooks with extras, Mozaik Teacher, Mozaik Student, etc.

4. Registration

It is necessary to have a user account to place an order at the mozaweb.com webshop. Customer shall be responsible for entering the information correctly during the registration process and for modifying the data entered in his/her user account if any change has occurred. Service Provider shall not be liable for any errors resulting therefrom.

5. Purchase

By placing a product/products into the cart and clicking on the ‘Order’ button, Customer makes an offer, thus establishing an obligation to pay.

In the event of a successful purchase by credit/debit card, Service Provider shall send the invoice to Customer electronically. In the event of paying in advance by bank transfer, Service Provider shall issue and send said invoice to Customer once the money is credited to Service Provider’s account.

In the case of successfully purchasing digital content, the Service Provider shall send to the Customer the licence key(s) required for activation together with the invoice.

Prices at the www.mozaweb.com and the www.cadaveranatomy.com webshops are denominated in euros and include VAT. In the event that only printed publications are purchased, the invoice shall be issued by Imosoft Kft. In the event that only digital content or both digital and printed materials are purchased, the invoice shall be issued by Service Provider.

6. Payment

Payment may be made by credit/debit card via SimplePay, PayPal or bank transfer.

If choosing the option of paying in advance by bank transfer, Service Provider shall register Customer’s order and issue a pro forma invoice (which can be downloaded from the user account and will be automatically sent to Customer via email as well). When carrying out the transfer, Customer shall provide his/her name and the number of the pro forma invoice in the Message field. Once the payment is credited to Service Provider’s account, Customer can access the purchased products in ‘My purchases’.

If Customer’s order contains only printed publications, cash on delivery payment is also available. In this case, the price of the purchased products shall be paid to the courier in cash or by bank card.

The total amount to be paid is shown in the order summary.

7. Completing the order

Service Provider shall make every effort to deliver or, in the case of digital content, provide access to products purchased by Customer by the deadline specified in the order. If it is not possible to complete an order, the contract shall be terminated. In the event that the order cannot be completed, Service Provider shall promptly inform Customer thereof. Printed publications shall be delivered only to Hungarian addresses.

In the event that printed publications are ordered, the order will be delivered to Hungarian addresses usually within five business days by the courier service working on a contractual basis with the Service Provider.

Printed publications ordered in the webshop shall not be delivered or posted to addresses outside Hungary.

8. Customer’s rights

Product warranty

Every Customer shall have the right to make a quality complaint about defective products. According to the Hungarian Consumer Protection Act, submitting a warranty claim shall not be considered a complaint.

If the product is defective or not the one ordered, please contact customer service at [Show] or call +(36-62) 554-660. Complaints might be processed more quickly if images of the defective product are included as well.

According to the provisions of Act V of 2013 on the Hungarian Civil Code, Customer may assert a warranty claim against Service Provider in the event of defective purchased products.

Service Provider’s delivery is defective if the product fails to meet the quality requirements defined in the contract or by law at the time the order is completed.

When asserting a warranty claim, Customer may choose to request a replacement, or, if a replacement is not possible, Customer may request a commensurate reduction in the consideration, or, as a last remedy, may choose to withdraw from the contract.

Further regulations on warranty are contained in Annex 3 to Hungarian Government Decree No. 45/2014 (II. 26.) on detailed rules for contracts concluded between consumers and businesses

Given the fact that the products offered at Service Provider’s webshop do not fall within the scope of products specified in the legislation on mandatory warranty, Service Provider’s warranty obligation shall not apply (Hungarian Government Decree No. 151/2003. (IX.22.); Hungarian Government Decree No. 270/2020. (VI.12); Decree No. 18/2020. (VI.12) issued by the Hungarian Ministry for Innovation and Technology).

Withdrawal/termination

According to Hungarian Government Decree No. 45/2014. (II.26.), Customer (natural persons considered consumers) may withdraw from a purchase without providing any reason within 14 days of receipt of the product. Customer shall be under obligation to inform Service Provider of the withdrawal within 14 days of receipt of the product by sending a clear statement by email ( [Show] ) or by completing the withdrawal declaration appended to the GTC.

In the event of withdrawal, Customer shall return the product(s) to Service Provider’s address as indicated on the invoice and Service Provider shall refund the original purchase price paid for the returned product(s) immediately but no later than 30 days after the product(s) are returned (shipping costs shall be assumed by Customer).

Customer may exercise his/her right of withdrawal between the date the contract was concluded and the date the product(s) was/were received.

In the event that digital content is purchased, Customer may exercise his/her right of withdrawal until the activation code(s) are used.

If Customer agrees to conclude a contract for the supply of services at the webshop, Customer has the right to terminate the contract instead of withdrawing. In the case of a contract for the provision of services, Customer may exercise his/her right to terminate the contract within 14 days of the conclusion of said contract. Customer may not exercise his/her right of termination after the service has been provided in full (e.g. Customer uses the activation codes) if Service Provider has commenced the service with the express prior consent of Customer and if Customer has acknowledged that Customer will lose his/her right to terminate the contract once the service has been provided in full. If Customer, in accordance with the above conditions, chooses to change or cancel his/her order, or modify the invoice after a successful transaction, Customer shall pay a handling fee of 30 EUR.

9. Handling complaints

Customer may request the intervention of a conciliation board for the simple, quick and out-of-court settlement of disputes (consumer disputes) with Service Provider. Service Provider shall be under obligation to cooperate in the conciliation procedure. The competent conciliation board in the location where Service Provider is registered is:

10. Relevant Hungarian legislation

Act on Civil Code (Act V of 2013);

Act CLV of 1997 on consumer protection;

Act CVIII of 2001 on certain issues of electronic commerce activities and information society services;

Decree No. 19/2014 (IV.29.) issued by the Minister for the National Economy on the procedural rules for administering warranty and guarantee claims on products sold to consumers under a contract between the consumer and enterprise;

Government Decree No. 45/2014 (II.26.) on detailed rules for contracts concluded between consumers and businesses;

Government Decree No. 151/2003 (IX.22.) on the statutory guarantee for certain durables, Government Decree No. 270/2020 (VI.12.) and Decree No. 18/2020 (VI.12.) issued by the Ministry for Innovation and Technology.

Annex

The registration process and other provisions

In order to register, Customer must provide his/her name, email address, country of residence and a password for future logins. Login data provide access to Service Provider’s all other online platforms providing service in the given country. Before finalising registration, Customer must accept the Terms and Conditions. The system shall confirm the registration via email. If the user is under the age of 16, parental consent is required.

Customer shall be responsible for treating his/her password confidentially. If Customer’s data is obtained by an unauthorised third party, after entering Customer’s username and password correctly during the identification process, Service Provider as Data Controller shall not be held responsible for any resulting damage or adverse events.

By providing the email address, Customer shall agree to receive technical messages from Service Provider.

Service Provider will delete the registered data from the system upon request of Customer. For security purposes, the removal request will be carried out once the request is confirmed by Customer via email so as to avoid a Customer intentionally or mistakenly deleting another Customer from the registration database.

The registration is identified using the email address; therefore, an email address can only be registered once. Registration places Customer under no obligation.

Purchase confirmation email

A confirmation email always contains Customer’s information, the name of the product, number of items, delivery information, payment method, and terms and conditions of delivery.

Correction of data entry errors – responsibility for the veracity of data provided

Before finalising the order, Customer shall always have the option to modify the data provided (click on the back arrow in a browser to return to the previous page, where you can modify any data again even if you have already advanced to the next page). Service Provider shall not be held responsible for completing an order based on inaccurate data entry.

Please note that an incorrect email address or a full mailbox may result in failure to deliver confirmation.

Procedure in the event of an incorrect price

In the event that a price is indicated incorrectly, Service Provider shall offer Customer the option to purchase the product at the actual price and Customer, being aware of this information, can decide whether to purchase the product at the actual price or cancel the order with no adverse legal consequences.

Newsletter

Service Provider’s system may collect data on Customer’s activity, which cannot be linked to information provided by Customer during the registration process nor to data provided in using other online websites or services not operated by Service Provider.

Service Provider is entitled to send newsletters or other advertising letters to Customer if Customer has granted his/her prior, clear, explicit and voluntary consent thereto by providing the relevant information during the registration or purchase. Service Provider shall be under no obligation to confirm the veracity of the data provided by Customer during registration or when granting his/her consent.

Customer may withdraw his/her voluntary consent at any time. In said event, Service Provider will send no more newsletters or other advertising letters to Customer and will delete Customer’s data from the newsletter subscribers’ database.

In all cases, reviews of products and other related feedback shall reflect the opinion of the users and the Service Provider shall take no responsibility for the content thereof. Service Provider shall reserve the right to delete reviews and comments that offend public taste, harm business interests or violate the law.
